Trade ATS Terms of Service & Licensing Agreement

By completing your purchase and checking the acceptance box, you (“User,” “Subscriber,” or “Trader”) agree to the following Terms of Service (“Agreement”) with Trade ATS LLC, its affiliates, and related entities (collectively, “Company,” “we,” or “us”). This Agreement governs your use of Trade ATS software, educational materials, and related services.

1. Confidentiality and Intellectual Property

  1. Confidential Information includes all non-public information about our software, strategies, educational content, internal communications, and proprietary methods.

  2. You agree not to disclose, copy, reverse engineer, or create derivative works from our software, content, or methods.

  3. All intellectual property remains the exclusive property of Trade ATS. Any unauthorized use may result in termination of access and legal action.

2. Subscription & Licensing

  1. Subscription Billing: Subscriptions are billed monthly starting at checkout and renew automatically.

  2. License Terms: One subscription permits use of the Trade ATS software on up to two TradingView accounts or devices. Additional licenses are required for more.

  3. Personal Use Only: Software and educational materials are for individual use and may not be shared, resold, or used for commercial purposes.

  4. Refunds: Unless otherwise required by law, all purchases are final and non-refundable. Trade ATS may, at its sole discretion, issue a prorated refund in cases of service cancellation.

  5. Cancellation: You may cancel anytime. Trade ATS also reserves the right to cancel accounts at its discretion.

3. Community and Security Rules

  1. You agree not to post screenshots, video captures, or descriptions of Trade ATS tools, strategies, or content on public platforms without prior written approval.

  2. You must maintain the confidentiality of your login credentials and subscription. Sharing access is prohibited.

4. Educational Disclaimer

  1. Trade ATS provides educational resources only and does not provide investment advice.

  2. We do not guarantee profits, outcomes, or results. All trading decisions are your own responsibility.

5. High-Risk Investment Warning

Trading financial markets carries a high level of risk and may not be suitable for all investors. Leverage can work against you as well as for you. You may lose more than your initial investment.

By accepting these terms, you acknowledge that:

  • You understand the risks involved.

  • You will not trade with money you cannot afford to lose.

  • You release Trade ATS from liability for any trading losses.

6. Prop Firm Services (If Applicable)

  1. Separate Agreement: If you engage in prop trading services through ATS Capital Partners or Prop Account LLC, those services are governed by a separate agreement and rules provided in your Welcome Email.

  2. Affiliate Relationship: Trade ATS is an affiliate of Prop Account LLC. Trade ATS does not collect or process any payments related to prop firm evaluations or accounts. All funds for prop firm services are paid directly to Prop Account LLC.

  3. Responsibility: Prop firm accounts are subject to risk management, trading limits, and profit split policies, which may change at any time.

  4. Refunds & Liability: Trade ATS will not be liable for any refund requests or disputes related to prop firm purchases. All refund or payment-related matters must be handled directly with Prop Account LLC.

  5. Liability: Trade ATS is not responsible for prop firm funding, execution, or payouts. Prop Account LLC holds all liability for prop trading services.

7. General Terms

  1. Prohibited Uses: You may not use our services to violate laws, infringe rights, scrape, hack, or abuse our systems.

  2. Disclaimer of Warranties: Services are provided “as-is” without warranty.

  3. Limitation of Liability: Our liability is limited to the lesser of (a) the subscription fees paid in the last 12 months, or (b) $1,000.

  4. Indemnification: You agree to indemnify and hold us harmless from claims arising from your use of our services.

  5. Governing Law: This Agreement is governed by Nevada law, and disputes will be resolved by binding arbitration in Nevada.

  6. Force Majeure: We are not liable for interruptions outside our control.

  7. Entire Agreement: This Agreement supersedes prior agreements and is binding upon acceptance.
